Terms of Service

1. Acceptance of Terms

By using the Cloud Sync task in the Task Scheduler, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Task Scheduler. Continued use constitutes acceptance of the Terms.

2. Service Description

The Task Scheduler allows configuration and management of Rclone remotes for Google Drive, Google Cloud Storage, and Dropbox using OAuth credentials. This service depends on third-party APIs, and 45Drives does not guarantee uninterrupted access or functionality.

3. User Responsibilities

You agree to:

• Use the Task Scheduler in compliance with all applicable laws and the terms of service of their cloud storage providers./li>
• Securely manage their OAuth credentials and Rclone configurations.
• Notify 45Drives immediately if they suspect unauthorized access to their configurations.

4. Limitation of Liability

• No Warranty or Guarantee: The Task Scheduler is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 45Drives does not guarantee that the Task Scheduler will be error-free, secure, or uninterrupted.
• Exclusion of Certain Damages: 45Drives is not liable for any incidental, special, consequential, or exemplary damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with the use of the Task Scheduler, even if advised of the possibility of such damages.
• Limitation of Liability Amount: In no event shall 45Drives’ total liability for any claims related to the Task Scheduler exceed the amount paid by the user for the use of the service in the 12 months preceding the claim, if applicable.
• Third-Party Providers: 45Drives is not responsible for the performance, availability, or reliability of third-party cloud storage providers (e.g., Google Drive, Dropbox) or the APIs they provide. Users acknowledge that these services are governed by the terms and conditions of their respective providers.
• User Misuse: 45Drives is not liable for damages caused by user errors, such as incorrect configurations, misuse of the Task Scheduler, or failure to secure credentials and access.
• Security Risks: While 45Drives takes reasonable measures to ensure the security of its software, users acknowledge that no system is entirely secure. 45Drives disclaims liability for any unauthorized access, hacking, or security breaches affecting user data.
• Force Majeure: 45Drives is not liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, labor disputes, government actions, or interruptions in Internet or telecommunications services.
• Indemnification: Users agree to indemnify and hold 45Drives harmless from any claims, damages, or expenses arising out of their use of the Task Scheduler, including but not limited to violations of these Terms, misconfigurations, or misuse of third-party services.

5. Privacy and Data Security

45Drives does not store or retain user OAuth credentials or Rclone configurations. Users are responsible for securing their own data.

6. Termination of Service

45Drives reserves the right to terminate or suspend the Task Scheduler at any time, with or without notice, for any reason, including but not limited to violations of these Terms.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Nova Scotia, Canada. Any disputes arising from these Terms will be resolved exclusively in the courts of Nova Scotia.
